Terms & Conditions

All clients should read this carefully before making a booking.

All models/Artistes introduced by the Agency (Starling) to the client must be booked through Starling for any future work related to the first booking.

 

CONFIRMATION

As required by Department of Employment regulations STARLING booking confirmation form containing the terms of the booking must be signed and returned by the client before any job takes place.

All fees’ are to be negotiated with Starling exclusively.

 

SHOOT FEES

Shoot fees are charged by the day or by the hour. Equity contracts excluded.

A normal day is considered between 8am and 6pm

All fees are based on the following –

 

Photo Shoots:

A full day is 8 hours

A half-day is 4 hours

 

TV / Moving Image shoots:

A full day is 10 hours

All rates include an hour taken for lunch

Unless otherwise agreed the minimum booking is for 2 hours.

In the event that models from other agencies are working on the same booking and providing the same service as models from Starling, Starling reserves the right to charge at the same rate as the other agency.

 

OVERTIME

The booking will be charged from the time specified by the client for the models arrival and detailed on the booking confirmation. If the shoot runs over the time agreed, an overtime rate will apply.

Over time rates apply before 8am and after 6pm. (on shoots over 8hours)

The overtime rate is added at 20% of the daily-negotiated rate per hour or part of and /or after 6pm and 33.3% of the hourly rate after Midnight.

If the over all day rate includes a day and the buyout fee the overtime rate is to be agreed before confirmation of booking.

 

DAWN CALLS

Dawn Calls are deemed if the artist is called between 04.00am – 07.30am. A premium payment of 20% of the BSF for each hour or part there of up to 07.30am is payable.

 

NIGHT SHOOTS

Night calls are especially called as such and should be negotiated up front before the client is booked.

Any Call to attend after 4.00pm shall be deemed to be for night work and the BSF will be at a minimum of £525 then any overtime is charged at 20% of that BSF for each hour after 8 hours for UK work or 10 hours for work outside the UK.

A call time after Noon means the day ends at 10pm and overtime applies there after at 20% up to 24.00 and 33.33% after midnight.

 

WEEKENDS

Above rates apply from Monday to Saturday with Double time charged for all shoots or travel on Sundays.

 

EXPENSES

If not specified on the booking confirmation, expenses are charged at 40p per mile or the cost of second-class rail fare.

 

TRAVEL

Travel is charged at 50% of the BSF for work overseas.

Travel to and from artists home to nearest UK airport will be charged @ £120

Cabs will be provided by the client for any job that falls outside of a time that enables model to travel home by public transport.

 

FITTING/RECALLS/MEALS

FittingFees are charged at half the hourly rate with a minimum rate of £50 per hour unless specified on the casting brief or at time of booking.

Measurements are correct at time of going to press. We cannot be held responsible for any subsequent changes and so details must be checked before making a booking.

Recall Fees are charged at £50 unless negotiated up front.

Meals if not provided by the Company then a Per Diem will of £50 per day will be paid on arrival.

 

IMAGE USAGE

The standard use covers the right to use the image in the UK only for up to 1 year unless otherwise agreed in writing.

In case that other Models from different Agents are booked on the same job but being paid at a higher rate Starling reserve the right to negotiate that same rate and be informed by the client of this rate (Unless it is specified within the different roles) This also applies for any additional usage that might be bought out after the first airing.

All images and footage once agreed, are payable whether or not the use is appropriated. When usage basic studio fee and usage fee is combined as one fee at the time of booking the usage is payable irrespective of it being taken up.

The proposed initial media, territory and length / period of usage of all still or moving images MUST be negotiated prior to the booking and will be shown on the Booking Confirmation sent by Starling Agency to the Client at the time of booking. If usage described within the Confirmation of Booking does not cover the required negotiated initial usage, the Client should contact Starling immediately and additional usage fees will be negotiated.

The photographer is NOT entitled to use any of the images he or she takes for any other usage than his or her personal portfolio beyond that agreed, negotiated and paid for through Starling Agency.

 

ADDITIONAL USAGE

It is the Clients responsibility to notify Starling of any further usage and to negotiate additional fees. Starling Agency reserves the right to quote the Client at a rate that it deems reasonable if extra usage / additional fees are not negotiated prior to any booking.

Video/Commercials

Additional fees are payable for the right to use the footage in any way whatsoever other than the initial agreed usage detailed on the booking confirmation. Unless otherwise agreed, TV commercial usage will be charged as per the rates calculated on www.usefee.tv.

 

EXCLUSION FEES / CONFILCTING WORK

It is the client’s responsibility to check with the artiste whether conflicting work has been done prior to booking

If a model advertises a product he/she is able to work for any competitor unless an exclusion fee is negotiated.

 

PROVISIONAL BOOKINGS OR “PENCILS”

Provisional bookings will be automatically cancelled if they are not confirmed within 24 hours of the proposed booking, or if a definite booking is offered and the provisional cannot be confirmed.

 

CANCELLATION FEES

If a booking is cancelled within 24 HOURS of the starting time weather that is the first travel day or shoot day, the full fee will be charged unless the same model is re-booked for another dates within 24 hours in which case half the fee will be charged.

If a booking is cancelled outright outside the 24-hour period but within five working days of the starting time, 50% of the fee will be charged.

If a booking is cancelled outside the five-day period, 25% of the fee will be charged.

Saturdays, Sundays and Bank Holidays are excluded from these calculations.

 

WEATHER DAYS

At the first cancellation, a half fee is charged unless the client fails to cancel in time to prevent the model’s attendance, when the full fee is payable. At the second cancellation the full fee is charged.

 

PAYMENT

VAT will be added as appropriate to all fees in accordance with the laws of the United Kingdom.

Starling charges 20% on the total of the negotiated quoted shoot rate, travel and usage fees

For Equity contracts based on repeats artist respective percentages will be 80% and 20%.

Payments on all invoices are required within 30 days of date of invoice unless otherwise specified by the client at the time of booking.

A 10% credit charge per month will be added to all invoices not settled within these payment terms.

Please note no use of any images is permitted until all relevant fees have been paid.

In all cases the person booking the model will be invoiced and solely responsible for payment, unless otherwise agreed in writing at the time of booking. In the case of non-payment by the person booking the model, Starling reserves the right to invoice the ‘ultimate client’ (i.e. advertising agency/designer/manufacturer/owner of the product in question).

All fees are for the right to use pictures or footage and, once agreed, are payable whether or not the use is appropriated.

If fees are invoiced to a client with an address outside the UK, the client must cover any bank charges charged by the client’s bank outside the UK and Santander bank in the UK. The full amount stated on the invoice must be credited to the Starling bank account without alterations due to exchange rates.

 

COMPLAINTS

Any cause for complaint should be reported to Starling when it originally arises. Complaints cannot be considered in retrospect.

Whilst every endeavour is made to provide a satisfactory and efficient service to our clients we cannot be held responsible for a model’s conduct on an assignment.

INSURANCE

The client will maintain adequate insurance cover to underwrite its obligations to the model.

It is the client’s responsibility to arrange insurance if indemnity is required against a model’s inability to attend through sickness or unforeseen circumstances.

The client is responsible for the models health and safety when the model is travelling, or providing services in connection with the booking to the same extent as if the model were an employee of the client.

Starling is not responsible for any losses, which may be incurred if the model fails to attend or is late to the booking. The client is advised to insure against any loss, which might result due to this.

 We reserve the right to negotiate within the structure of these terms and conditions.
